These Terms of Service ("Terms") govern your access to and use of the services provided by Custodia LLC ("Custodia"), including our website, the CMMC Fortress subscription, and the Live Verification Badge.
1. Acceptance of Terms
By accessing our website or subscribing to our services, you agree to be bound by these Terms. If you represent a company, you certify that you have the authority to bind that entity to these Terms.
2. The Live Verification Badge
License: Subject to your compliance with these Terms and active subscription status, Custodia grants you a limited, non-exclusive, non-transferable license to display the "Live Verification Badge" on your website.
Restrictions: You may NOT:
- Modify the code snippet, badge appearance, or validation logic.
- Display the badge if you are not in good standing with your CMMC/NIST compliance, as determined by Custodia.
- Use the badge to mislead Prime Contractors or the government regarding your certification status.
We reserve the right to remotely disable the badge if we detect non-compliance or unpaid service fees.
3. Intellectual Property
All content, trademarks, code, and interfaces on this site are the exclusive property of Custodia LLC. "Custodia", "CMMC Fortress", and the Shield Logo are trademarks of Custodia LLC.
4. Use of Services
You agree not to misuse our services. You must not:
- Scan or test the vulnerability of our systems (except through authorized bug bounties).
- Reverse engineer our badge validation API.
- Use our services to store or transmit illegal or classified (Secret/Top Secret) material. We are designed for CUI/FCI Level 1 environments only.
5. Disclaimer of Warranties
The services are provided "AS IS". While we strive for accuracy in our assessments, we do not guarantee that your company will pass every external audit. Compliance is a shared responsibility.
6. Limitation of Liability
To the fullest extent permitted by law, Custodia LLC shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the service.
7. Governing Law
These Terms are governed by the laws of the United States and the State of Delaware.
